Information Regarding the California Board of Psychology (BOP)

Good morning,

The Board of Psychology (Board) will meet on Friday, August 18, 2023 via WebEx.

Agenda items include a presentation on updates to the Health Care Access and Information (HCAI) Loan Repayment Program, Education Capacity Expansion Programs, and Social Work Initiatives and Funding Sources Not Available to Psychologists.

Also on the agenda is a presentation by the Dean of The Wright Institute regarding mental health service support for students in graduate programs in Psychology.

Board Committees will report on recent activities and make recommendations to the full Board for consideration and possible approval.

Licensed psychologists will also receive continuing professional development credit for attendance at the meeting.

Licensees who are expiring in 2023 can renew their license using either traditional continuing education or Continuing Professional Development (CPD). The 36 hours required can be obtained via CPD or traditional continuing education. Additionally, the Laws and Ethics requirement can also be met using traditional continuing education or CPD.


Please note that if using traditional continuing education to fulfill your renewal requirements, the cultural diversity and/or social justice is not required to be completed this renewal.

If you have completed all these requirements, whether using CPD or traditional CE, then you may answer “yes” to the renewal questions on Breeze.

Effective January 1, 2023, the Board of Psychology will offer a Retired license status.

History:

Senate Bill (SB) 1193 (Hill, Chapter 484, Statutes of 2016) was signed by Governor Brown, on September 22, 2016. This bill added Section 2988.5 to the Business and Professions Code (BPC), effective January 1, 2017, which gives the California Board of Psychology (Board) the authority to issue a license in retired status to a psychologist who holds a current active or inactive license in good standing, issued by the Board.

This regulatory change implemented the provisions of BPC section 2988.5 allowing the Board to issue a license in retired status. This status is non-renewable and requires a one-time payment of $75 to accompany an application through BreEZe or the Board’s form here:

SB 1428 (Archuleta, Chapter 622, Statutes of 2022) was signed by the Governor on September 27, 2022.

This bill adds Article 10 to the Psychology Licensing Law, commencing with Business and Professions Code (BPC) section 2999.100 to create a new registration within the Board for psychological testing technicians.

SB 401 (Pan, Chapter 298 Statutes of 2022) was signed by Governor Newsom on September 13, 2022. This bill amends Business and Professions Code sections 2960 and 2960.1 to clearly define sexual abuse, sexual contact, and sexual misconduct–along with adding and defining sexual behavior–to the list of what is considered unprofessional conduct for licensed psychologists and registered psychological associates. This bill also clearly authorizes an Administrative Law Judge to include an order of revocation in a proposed decision that finds a licensee or registrant has engaged in sexual abuse, sexual behavior, or sexual misconduct.

As long as a qualifying degree as specified in the Business and Professions Code Section 2914 is obtained from an academic institution that is regionally accredited, it will remain acceptable. The regional accredited organizations are Higher Learning Commission (HLC), Middle States Commission on Higher Education (MSCHE), New England Commission of Higher Education (NECHE), Northwest Commission on Colleges and Universities (NWCCU), Southern Association of Colleges and Schools Commission on Colleges (SACSCOC), and WASC Senior College and University Commission (WSCUC).

The California Board of Psychology’s Continuing Professional Development (CPD) regulation package was approved and becomes effective January 1, 2023. This package changes the continuing education guidelines and requirements that must be completed by a licensee as a condition of renewal or reactivation of their license.

Due to the COVID-19 pandemic and the changing nature of local indoor guidelines, beginning on July 1, 2021, the Board of Psychology is providing a 6-month grace period to allow the one hour face-to-face, direct, individual supervision to be conducted via HIPAA-compliant video until January 1, 2022. The trainee should indicate the face-to-face was completed using HIPAA compliant technology during the COVID-19 pandemic in the weekly log. Beginning on January 1, 2022, this grace period was extended for 3 months and scheduled to end on March 31, 2022. Beginning on April 1, 2022, this grace period will be further extended for an additional 6 months and end on September 30, 2022 or until the lift of the declared emergency, whichever occurs first.

AB 107 (Salas), Licensure: veterans and military spouses: https://www.psychology.ca.gov/laws_regs/ab107.shtml
This bill changes Section 2946 under the Business and Professions Code to allow military spouses who are licensed in another state, and who have applied for licensure as a psychologist in California, to continue to practice psychology under the other state’s license for a year from the time they applied with the Board, or established residency in California, whichever occurs first.

This is the Board's Sunset Extension bill, which eliminates the registered psychologist registration, changes the name of the registered psychological assistant, and includes other changes.

The following waivers have been issued/extended by the Department of Consumer Affairs:

Division 2 (Healthcare Licensees) Continuing Education and Examination Waiver Extension – allows licenses expiring between October 1, 2021, and October 31, 2021, six extra months from the date of the order to complete continuing education in order to renew their licenses. Global Examination Eligibility Extension (Last Extension) – extends prior waiver by 30 days to applications expiring between October 1, 2021, and October 31, 2021, and extends their eligibility to take examinations by six extra months, as discussed in the waiver. In 2018, Governor Jerry Brown signed into law AB 2138 (Chiu, Chapter 995, Statutes of 2018). This bill sought to reduce barriers to licensure for individuals who had rehabilitated from criminal convictions. In order to implement this bill, the Board of Psychology (Board) promulgated regulations which became effective on February 8, 2021. These approved regulations change existing regulations with respect to the substantial relationship and rehabilitation criteria to ensure the Board’s licensing requirements are consistent with the changes made by AB 2138.

Specifically, the Board may not deny a license solely because the applicant was convicted of a crime, or due to the acts underlying the conviction, if the applicant has a certificate of rehabilitation, was granted clemency, made a showing of rehabilitation, or the conviction was dismissed or expunged. Absent these circumstances, these regulations permit the Board to deny a license when an applicant has been convicted of a crime, if the crime is substantially related to the qualifications, functions, or duties of the regulated business or profession. The Board may also deny a license for substantially related professional misconduct that results in formal discipline by another licensing board. These regulations also establish the criteria that the Board can utilize to evaluate the rehabilitation of a person when considering the denial, suspension, or revocation of a license.

Additionally, due to the COVID-19 pandemic and the changing nature of local indoor guidelines, beginning on July 1, 2021, the Board is providing a 6-month grace period to allow the one hour face-to-face, direct, individual supervision to be conducted via HIPAA-compliant video until January 1, 2022. The trainee should indicate the face-to-face was completed using HIPAA compliant technology during the COVID-19 pandemic in the weekly log.

Time to Satisfy Examination Requirement

The Order Extending Time To Satisfy Examination Requirements for psychologist applicants for initial licensure has been issued by the Department of Consumer Affairs. Continuing Education

If you have a license that expires between March 31, 2020 and September 30, 2021, and don’t have your Continuing Education completed, you can take advantage of DCA’s Continuing Education waiver. If you are interested, and qualify based on the expiration date range above, you will have until January 26, 2022, to complete all renewal related Continuing Education requirements (36 hours with 9 live or live interactive).

This additional time is provided as part of DCA Waiver DCA-21-175 Order Waiving License Renewal Requirements, which allows for six months from the issuance date of the Waiver to complete the Continuing Education requirement. This waiver does not excuse you from the need to renew your license. When you are completing the renewal application, answer the Continuing Education renewal questions truthfully, and after your renewal is submitted with payment, our computer system will take it from there. You are to retain your CE records for a minimum of four (4) years; the Board conducts random audits and, if selected, you will be contacted for proof of completion.

The Board of Psychology has four new advisories related to legislation that became effective January 1, 2021. The advisories are for the following bills:

AB 2113 (Low), Refugees, asylees, and special immigrant visa holders: professional licensing: initial licensure process (effective January 1, 2021). AB 2113 added Business and Professions Code section 135.4, which requires boards and bureaus under the Department of Consumer Affairs (DCA) to expedite the initial licensure process for refugees, asylees, and special immigrant visa holders.

AB 2253 (Low), Professional Licensure (effective January 1, 2021). AB 2253 clarifies that in a training setting exempt from registration with the Board pursuant to either the Health and Safety Code, Penal Code, or Welfare and Institutions Code, experience that constitutes qualifying experience for licensure, means experience that meets the requirements of 2914(d) of the California Business and Professions Code.

SB 1474 (BP&ED), Business and Professions (effective January 1, 2021). SB 1474 extends the statutory authority of the Board of Psychology until January 1, 2022.       

AB 1145 (Cristina Garcia) Child Abuse: Reportable Conduct (effective January 1, 2021). For the purposes of the Child Abuse Neglect Reporting Act (CANRA), AB 1145 revised the definition of sexual assault to no longer include any acts under Penal Code Sections 286 (sodomy), 287 or former Section 288a (oral copulation), and Section 289 (sexual penetration), if committed voluntarily and if there are no indicators of abuse, unless the conduct is between a person 21 years of age or older and a minor who is under 16 years of age.

 The California Departments of Health Care Services (DHCS) and Public Health (CDPH) and the Office of the California Surgeon General (OSG) are reaching out due to the ongoing concerns of the coronavirus (COVID-19) epidemic and the immediate and long-term impacts on the mental health of California’s residents. Mental health concerns resulting from social isolation, financial insecurity, and unemployment increase deaths from suicide, overdose, and illness and further exacerbate inequities.

Health care providers have an opportunity to screen, intervene, and prevent these events.

The Department of Consumer Affairs has issued the following waivers: 

•       DCA Waiver DCA-20-27 Waiver Extending DCA Waiver DCA-20-01 Continuing Education - https://www.dca.ca.gov/licensees/dca_20_27.pdf 
For active licensees that expire between 7/1/20, and 8/31/20, the Director temporarily waives any statutory or regulatory requirement that an individual renewing a psychologist license to be in compliance with, any continuing education requirements in order to renew a license. CE requirements must be satisfied within 6 months of this 7/1/20 Order.


•       DCA Wavier DCA-20-29 Waiver Extending DCA Waiver DCA-20-10 Face-to-Face Supervision Requirement for Psychology Trainees - https://www.dca.ca.gov/licensees/dca_20_29.pdf


The Director hereby extends the Order Waiving Face-to-Face Supervision Requirements for Psychology Trainees by an additional 60 days. The order now terminates September 3, 2020, unless further extended.

Dear Stakeholders - 

In response to state and local stay at home orders to help reduce the spread of COVID-19, the Board of Psychology temporarily closed its office to the public in March.

Following a detailed risk assessment and implementation of a COVID-19 prevention plan, we will reopen our offices to the public on June 15. Offices will resume normal hours of operation Monday through Friday from 8:00 a.m. to 5:00 p.m.

Thank you for your patience and understanding as we work under new protocols and procedures and continue to adjust to this ever-changing situation.

The Board of Psychology is pleased to share the newly revised consumer brochure Therapy Never Includes Sexual Behavior. This brochure revision was completed in coordination with the Board of Behavioral Sciences, the Medical Board of California, the Osteopathic Medical Board of California, and the Department of Consumer Affairs. 

The Therapy Never Includes Sexual Behavior brochure informs consumers that therapy never includes sexual contact (e.g. intercourse or touching of an intimate body part) between a therapist and a client, inappropriate sexual suggestions, or any other kind of sexual behavior between a therapist and a client. The revised brochure informs consumers of potential warning signs of inappropriate sexual behavior, their rights as a patient, information on where to get help if they have been the victim of sexual behavior by a therapist or former therapist, and how to file a complaint with the appropriate licensing entity.

•           If a licensee or their employer becomes aware of any alleged incident(s) of sexual intercourse, touching of an intimate body part, or sexual behavior(s) between a previous psychotherapist of a client or patient during the course of previous treatment(s), the licensee must provide the client or patient a copy of the brochure Therapy Never Includes Sexual Behavior and discuss the brochure with the client or patient.

•           Primary supervisors are required to review the Therapy Never Includes Sex Behavior brochure with their trainees.
